How should we prepare for the 2024 EEO-1 reporting changes, especially with updates to gender reporting and filing deadlines?
Answer
The 2024 EEO-1 reporting season will open on May 20, 2025, and close on June 24, 2025. This year, there are several important changes employers need to know before submitting their reports.
First, the US Equal Employment Opportunity Commission (EEOC) has eliminated the option to categorize employees as “non-binary.” All employees must be reported as either male or female — a significant shift from previous years. In addition, the EEOC has removed the “Notice of Failure to File” process, meaning late reports may no longer be accepted. Finally, the procedure for requesting an undue hardship exemption has changed, and employers needing extra support should be prepared to act early.
