Navigating the Unique Health-Care Compliance Landscape: A Guide for Employers

If you have employees in Massachusetts, you’re likely aware that you’re responsible for complying with both the federal Affordable Care Act (ACA) and the state’s own health-care mandate. Navigating the intricacies of both can be complex, especially considering that Massachusetts has its own unique set of requirements that pre-date and differ from the ACA.

While the federal individual mandate penalty no longer applies, Massachusetts still enforces its own individual health-care mandate. This means that your employees who reside in the state could still face penalties for not having health-insurance coverage, even though the federal penalty has been eliminated.

Managing these dual responsibilities can be a challenge. However, by understanding the key differences between the federal and state mandates, and taking proactive measures to ensure compliance, you can effectively navigate these requirements and protect your organization, and your employees, from potential penalties.

Key Compliance Complexities for Massachusetts:

  • Unique Requirements: Massachusetts’ mandate diverges from federal ACA rules, requiring employers to be well-versed in both state and federal laws. While the federal government requires employers to offer minimum essential coverage, with its own criteria and requirements, Massachusetts requires employees to be enrolled in minimum creditable coverage, with different criteria and requirements.
  • Form MA 1099-HC: This state-specific form must be distributed to employees and filed with the state. While it may seem like an extra step, it’s an important part of fulfilling your reporting obligations. Failure to meet these reporting obligations can result in substantial penalties of $50 per individual with an annual maximum of $50,000 for failure to issue MA 1099-HC.
  • Multiple Employees: If your company has six or more employees in Massachusetts, you must annually submit the MA Health Insurance Responsibility Disclosure (HIRD) form.
  • Data Format and Submission: The electronic filing process through MassTaxConnect, requiring a specific XML format, can pose technical hurdles.
  • Tight Deadlines: The January 31 deadline for distributing forms and submitting data adds pressure, especially during the busy tax season.
  • Potential Penalties: Non-compliance can lead to significant financial penalties, underscoring the importance of accuracy.
  • Technological Challenges: Gathering and validating employee data, as well as integrating systems with MassTaxConnect, can be time consuming and require technical expertise.

Additional Considerations:

  • Self-Insured Employers: Third-party administrators (TPAs) may not always handle MA state reporting for self-insured employers, leaving employers to manage it independently.
  • Changing Regulations: Staying abreast of evolving state and federal healthcare laws can be overwhelming for employers lacking dedicated compliance resources.

To help navigate these complexities, employers need a comprehensive health-care reporting solution that addresses state-specific reporting requirements and adapts to changing regulations. Seek a partner with deep expertise in state rules, a commitment to technology that supports evolving mandates, and established relationships with state governments to anticipate and address upcoming changes.
