The US Citizenship and Immigration Services (USCIS) will publish on August 1 a revised version of the Form I-9, the Employment Eligibility Verification. Among the changes to the Form I-9 is a check box allowing employers who are enrolled in E-Verify to remotely examine identity and employment authorization documents.
For employees hired on or after March 20, 2020, whose documents were examined remotely, employers must conduct an in-person examination of the documents by August 31, 2023. But employers who were enrolled in E-Verify during the COVID-19 flexibilities period (March 20, 2020 to July 31, 2023) may now choose to use the check box on the new Form I-9 to satisfy the physical document examination requirement for employees hiring during that time. This must also be completed before August 31, 2023.

The revised Form I-9 will be available on the USCIS website. Employers may continue to use the current Form I-9 until October 31, 2023. Starting November 1, 2023, all employers are required to use the new Form I-9.
